At Yieldpatha SpA we handle your personal data responsibly under the framework of Chile's Privacy Protection Law No. 19,628 and, where applicable, the EU General Data Protection Regulation 2016/679. This policy describes what information we collect, why we collect it and what rights you can exercise at any time.
1. Data controller
Yieldpatha SpA, Tax ID 77.412.908-3, with offices at Av. Apoquindo 4500, office 1203, Las Condes, Santiago, Chile, is the entity responsible for personal data collected through yieldpatha.com. For any query, write to privacidad@yieldpatha.com.
2. What we collect
We collect the information you voluntarily provide through the contact form (name, email and message), basic technical data (IP address, browser and device) and browsing data generated by cookies when you grant consent. We do not collect sensitive data or financial information through this site.
3. Purposes
We use the data to respond to your requests, manage the commercial relationship prior to any investment, send communications only when you authorise it, measure site performance and prevent fraud. We do not take automated decisions with significant legal effects.
4. Legal basis
Processing is based on your express consent when submitting the form, on our legitimate interest in keeping the platform secure and on legal obligations applicable to crowdfunding operators in Chile.
5. Retention
We keep your data for as long as necessary to meet the stated purposes and, afterwards, for the applicable legal periods (generally up to six years from the last contact, unless a longer legal obligation applies).
6. Recipients
Your data may be processed by technology providers acting as processors (hosting, email, analytics) under data processing agreements. We do not sell personal data and we do not share it with third parties for their own commercial purposes.
7. International transfers
Some providers operate outside Chile (for example in the European Union or the United States). In those cases we require equivalent safeguards such as standard contractual clauses or adherence to frameworks recognised by the supervisory authority.
8. Rights
You may exercise the rights of access, rectification, cancellation and objection, and withdraw your consent at any time by writing to privacidad@yieldpatha.com. You can also file complaints with the Chilean National Data Protection Agency once it is operational.
9. Security
We apply reasonable technical and organisational measures, including TLS encryption, role-based access controls and periodic audits, to protect the integrity and confidentiality of your information.
10. Changes
We may update this policy to reflect regulatory or platform changes. Any modification will be published on this same page indicating the date of the latest update.
